I acknowledge and agree that this Agreement covers and is intended to release Busy Bee Island LLC, and its respective and collective agents, owners, officers, managers, shareholders, parent, subsidiaries, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their respective or collective behalf (collectively referred to as Busy Bee Island).
In consideration of being allowed to use and participate in Busy Bee Island premises, equipment, services and activities, including, but not limited to swing, slide and any other amusement or recreation activities (collectively “ACTIVITIES”), I, on behalf of myself, and/or on behalf of my minor child(ren), hereby agree as follows:
ASSUMPTION OF RISK: Even when precautions have been taken to avoid any injuries, any time a child participates in any physical activity, there is a chance of injury and parents/guardians should be aware of this fact. The parent/guardian also agrees that while our toys and equipment are all rated as safe when used appropriately by children ages 0-17 years old, it is the parent/guardian’s responsibility to always supervise their child(ren) at all times while in the play space, and to use their own judgment regarding each child’s abilities and which activities and equipment are safe and appropriate for his/her abilities and limitations.
I acknowledge that I and/or my child(ren), for whom I represent that I have full authority as parent or legal guardian to bind the minor participant to this agreement, am voluntarily participating in the ACTIVITIES, which I agree are dangerous and entail both known and unknown inherent risks, including the risk of injury, permanent disability, or even death, deriving from, but not limited to, equipment malfunctions; building malfunctions; lack of supervision and/or trained trampoline monitors; lack of proper equipment or padding, netting, or other safety measures; slipping; falling; landing; or colliding with fixed objects or other people, as well as the negligence and/or omissions committed by me, my child(ren), Busy Bee Island, and/or any other person and/or entity. I hereby voluntarily assume all such risks. I further understand and acknowledge that Busy Bee Island does not manufacture the equipment in its facilities but purchases and/or leases the equipment and therefore Busy Bee Island may not be held liable for defective products. I and/or my child(ren) are physically fit and know of no medical or health reason whereby I and or my child(ren) should not participate in the ACTIVITIES.
I am fully aware, understand, and agree to all terms and will abide by the rules provided by Busy Bee Island.
RELEASE OF LIABILITY: I hereby irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue Busy Bee Island from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or my child(ren)/ward(s) use of Busy Bee Island premises, equipment, services and activities, including without limitation any claim for negligence, arising from property damage, personal or bodily injury, emotional injury, illness, or death to the maximum extent allowed by law.
LIABILITY FOR PROPERTY: Busy Bee Island is not liable to you or your guests, child(ren) for any personal property that is damaged, lost, or stolen while on or about the Busy Bee Island premises including, but not limited to, a vehicle or its content or any property in a cubby, on any property within the premises whether or not by Busy Bee Island was negligent.
